Are we as a carrier required to keep paper logs?
No. The FMCSA allows you to keep electronic copies so long as
the signature is visible/verifiable. You are explicitly given permission
to destroy paper originals, which is why truck-stop scanning and in-cab
scanning have a long history of use. See the
FMCSA Interpretation for details.
Has the FMCSA approved Eclipse Logbook and Certified Faxes?
The FMCSA does not approve or endorse any commercial systems. However,
they have long accepted logs delivered electronically, such as by fax
or by truck-stop scanning.
Some people are concerned that Question 27 at the
interpretations page for section 395.8 may be a problem for carriers that
utilize our Certified Fax service.
Question 27 disallows digital signatures if they are NOT in the driver's handwriting.
Since Eclipse Logbook lets the drivers sign in their actual handwriting, the logs
should be considered compliant.
If your company would like an added layer of protection, you can have your drivers
turn in their hand-signed hard-copy logs as a back-up. You wouldn't even need to
file or sort them; just keep them in bulk for validation should the FMCSA want
to verify their existence. After six months the paper back-ups can be discarded.
Many people also think the FMCSA may soon issue new regulations or interpretations allowing
ALL digital signatures (not just those in the driver's handwriting) because of the following
facts:
- Congress passed legislation requiring all private companies to accept
digital signatures
- You can file many Federal forms including Federal Tax forms with digital
signatures
- The FMCSA recently accepted comments for a potential rulemaking regarding digital
signatures.
If you have any concerns please request the advice of your company management
or legal councel because all use of our products is at the user's risk.
